You probably can’t imagine a time when there weren’t any tips when you go to a restaurant. It’s become a part of our culture for a long time now. But recently, it’s becoming a bit too much. You may have been in a situation where you felt the pressure of leaving a big tip.
Now, some Times Square NY restaurants have been adding tipping guides and gratuity suggestions or adding the tips to the checks beforehand. One person filed a lawsuit against the Cheesecake Factory that claims that he paid a 40% tip in one restaurant because the tip amounts were calculated based on the total instead of his portion since he was splitting the check, as reported by TipHero. After reading this, you will probably calculate twice before paying the suggested gratuity on your bill.
It’s common for suggested gratuities to be included right above or below the total amount of your check. They usually range from 15 to 22 percent. However, Marcel Godman, mistakenly double tipped on a meal at the Cheesecake Factory, when he split the bill with another diner. Goldman’s portion of the bill totaled $38.50, but he left a $15.40 tip as was suggested by the receipt, this would translate to 20 percent. But, then he realized, he actually tipped 40 percent.
Here’s what the receipt suggested for his $38.50 bill.
- 15 percent, $11.55
- 18 percent, $13.86
- 20 percent, $15.40
- 22 percent, $16.94
So, if you did the math, what’s 20% of $38.50?
$7.70 is the answer, which means the amount of Marcel’s check was doubled! Of course, there are two sides to this story.
In response to the lawsuit, a spokesperson for The Cheesecake Factory sent an e-mailed statement to Delish, the restaurant is claiming that the gratuity amounts are only suggestions. So, why then are they adding them to the check?
“Guests are free to tip as they please,” the statement says. “We believe our guests appreciate service provided by our hardworking staff and tip accordingly.”
But, the lawsuit also alleges that The Cheesecake Factory is deceiving customers at all locations. Other customers have been complaining online about this. The story has been getting a lot of attention and people started reacting about similar experiences.
Here is an example of a person who decided to share it on social media.
